IN THIS POST: In honor of Indigenous People's Day Sam Seder spoke with Peter d'Errico on The Majority Report about Federal Anti-Indian Law: The Legal Entrapment of Indigenous Peoples; But first, Emma Vigeland talked to Israeli journalist Orly Noy about the war situation in Israel and Palestine.
On October 9, 2023, I was interviewed by Sam Seder on the Majority Report. He began by asking about my book, Federal Anti-Indian Law: The Entrapment of Indigenous Peoples … and that led to a lively conversation…
The overall theme was the evolution of doctrines of settler colonialism in what is now the United States, starting with the doctrine of ‘Christian discovery’ that launched the colonial era from Spain and England setting the stage for the US “manifest destiny” agenda.
We explored the central cases in the establishment of Chief Justice John Marshall’s doctrine of Christian ‘dominion’ that said Native peoples were a sub-human class who could not own land.
After expanding on the doctrine’s secondary purpose as a reinforcement of federal domination over the states, we looked at how the Supreme Court is carrying this doctrine forward into the present day while slowly obscuring its origins, seeing it affirmatively cited even by supposedly progressive justices like Ruth Bader Ginsburg.
We wrapped up by walking through contemporary battles over the domination doctrine, including Standing Rock, Oak Flat, Thacker Pass, and the push for full assimilation of Indigenous peoples.
